1. AGREEMENT TO TERMS

Your use of www.bethanyspantry.com (the "Site") constitutes your agreement to these Terms. If you do not agree, you may not use the Site. Bethany's Pantry Incorporated ("Bethany's Pantry") provides natural health products subject to your acceptance of these Terms without modification.

2. HEALTH & FDA DISCLAIMER

IMPORTANT: Statements regarding dietary supplements have not been evaluated by the FDA. Our products are not intended to diagnose, treat, cure, or prevent any disease.

  • Individual Results: Results vary significantly by individual.

  • Consultation: Always consult a physician before starting any supplement, especially if pregnant, nursing, or taking medication.

  • Information Only: Content on this Site is for informational purposes and is not medical advice.

In addition to our supplement products, the Site offers various food products. While we strive to provide accurate nutritional and allergen information provided by our partners, you should always consult the physical product packaging for the most up-to-date ingredients and safety warnings before consumption.

3. SUBSCRIPTIONS, CANCELLATIONS & REFUNDS

  • Subscriptions: Enrollment in any recurring plan constitutes "Express Affirmative Consent" to be charged at your selected frequency. You may cancel exclusively online via your [Customer Portal] at least 24 hours before your next charge.

  • Refund Policy: For full details on eligibility, restocking fees, and defective product returns, please refer to our [Refund Policy], which is incorporated into these Terms by reference.

  • Restocking Fees: Per our policy, unopened returns may be subject to a restocking fee and deduction of shipping costs.

4. MASS ARBITRATION & DISPUTE RESOLUTION

To the maximum extent permitted by law, any dispute shall be resolved via binding arbitration in the State of Washington under AAA Rules.

  • Informal Resolution: Before filing arbitration, you agree to a 60-day informal negotiation period by emailing info@bethanyspantry.com.

  • Mass Arbitration Protection: If 25 or more similar claims are asserted against Bethany's Pantry by the same or coordinated counsel, you agree to a "Batched Arbitration" process to manage filing fees and efficiency.

  • No Class Actions: You may only bring claims in your individual capacity.

5. LIMITATION OF LIABILITY

BETHANY'S PANTRY IS NOT LIABLE FOR ANY INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE USE OF THE SITE OR PRODUCTS IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

6. INTELLECTUAL PROPERTY

All text, graphics, logos, and "Protein Bake" formulations are the property of Bethany's Pantry. You are granted a revocable license for personal, non-commercial use only. Resale of products is strictly prohibited unless authorized via a Wholesale Agreement.


Third-Party Products (“The Curated Pantry”)

Bethany’s Pantry offers select third-party products through our Curated Pantry collection. These products are manufactured, packaged, and shipped by their respective brand owners or authorized fulfillment partners. Bethany’s Pantry is not the manufacturer of Curated Pantry products.

While we carefully curate partner brands that align with our quality standards, we do not independently verify or guarantee the manufacturing processes, ingredient sourcing, allergen controls, or regulatory compliance of third-party products beyond what the manufacturer represents to us. Product warranties for Curated Pantry items are limited to those provided by the original manufacturer. For product-specific safety, allergen, ingredient, or quality questions about Curated Pantry items, we recommend contacting the manufacturer directly.

Limitation of Liability for Third-Party Products

To the maximum extent permitted by applicable law, Bethany’s Pantry shall not be liable for any claims, damages, or losses arising from the use of third-party products sold through the Site. This includes, but is not limited to, product defects, allergen cross-contamination, foodborne illness, or inaccurate product labeling by the manufacturer. By purchasing Curated Pantry products through the Site, you acknowledge that Bethany’s Pantry acts as a marketplace facilitator for these items.
